Terms and conditions for competitions and prize draws

FreshSurf Cotillo S.L. (hereinafter referred to as FreshSurf) runs competitions and prize draws from time to time. Participation in these competitions/prize draws is subject to the following terms and conditions, unless separate terms and conditions are explicitly referred to.

Conditions of participation/prize draw

Participation in the competition is free of charge and does not depend on purchasing any goods or services. Only participants who have completely and correctly carried out the actions described in the competition and required for participation will be included in the draw. Only one prize per participant is possible. Cash payment or transfer of the prize to other persons is excluded. Winners will be notified in writing by FreshSurf. If a winner does not confirm the prize to FreshSurf by email within 14 days of notification, the claim to the prize lapses and a substitute winner will be drawn in the same way. The participant is responsible for the accuracy of the address provided.

By submitting content (image, text, video), the participant expressly guarantees that they hold all necessary rights to the content. By submitting, they also automatically agree to the content being published on www.freshsurf.de and, where applicable, on social networks (https://www.facebook.com/FreshSurf.Wellenreiten, https://twitter.com/freshsurf, https://www.youtube.com/user/FreshSurfFuerte, https://instagram.com/fresh_surf).

Eligibility

Unless otherwise stated in the competition, all persons aged 18 and over who are resident in Germany, Austria or Switzerland are eligible to take part. To take part in the competition/prize draw, the participant must provide truthful personal data. Employees of FreshSurf, its affiliated companies and competition partners, including relatives of the aforementioned groups, are excluded from taking part. FreshSurf is entitled to exclude individual persons from taking part if there are legitimate reasons, such as breach of the terms and conditions, multiple entries, unlawful influence on the competition, manipulation, etc. In such cases, prizes may also be revoked and reclaimed retrospectively.

Changes to the terms and termination of the competition

FreshSurf reserves the right to change the terms and conditions at any time. FreshSurf also reserves the right to end or interrupt the competition or prize draw at any time without notice for good reason. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from running as planned. If such termination is caused by the conduct of a participant, FreshSurf is entitled to demand compensation for the resulting damage from that person.

Limitation of liability

FreshSurf is only liable for damage caused intentionally or through gross negligence by FreshSurf, its legal representatives or agents, or through the breach of essential obligations in connection with the competition/prize draw (so-called cardinal obligations). Essential obligations are those whose fulfilment is necessary to achieve the purpose of the competition/prize draw. In these cases, liability is limited to the foreseeable damage that typically occurs. FreshSurf’s liability for damage resulting from injury to life, body or health remains unaffected.

Data protection

All personal data of the participant will be stored and used exclusively for the purpose of carrying out and processing the competition/prize draw. The participant is free to withdraw from the competition/prize draw at any time. Withdrawal should be sent to: office@freshsurf.de
